Terms of sale
1. Who we are
Niaash Fabrics is operated by NIAASH DIGITAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Pabianicka 61, 95-030 Rzgów, Poland. NIP: 7312071338. KRS: 0000893307. Registry court: Sąd Rejonowy dla Łodzi Śródmieścia w Łodzi, XX Wydział Gospodarczy Krajowego Rejestru Sądowego. Share capital: PLN 50,000. Contact us at niaashdigital@gmail.com or +48 799 079 839. Correspondence and returns may be sent to the address above.
2. What you are ordering
Our store offers fabric printing and fabric products described on each product page. Application images show possible uses of the print; clothing, furniture and accessories pictured are not included unless expressly listed as the product being sold. Check the fabric, design reference, quantity, unit of sale and specification before submitting your order. Screen previews are illustrative and are not calibrated colour proofs or certified measurements. This does not limit our responsibility to supply what was agreed.
3. Accounts, prices and payment
Sign in before checkout and provide accurate contact, billing and delivery details. Product prices shown to consumers include applicable VAT. Delivery is charged separately and the final total and available payment methods are displayed before you place the order. No extra charge or change to the agreed specification will be imposed without your agreement. Optional marketing consent is separate from placing an order. Contact us if you require assistance with invoice details.
4. Order acceptance
The sales contract is concluded when you receive the order-confirmation email in which Niaash accepts your order. Order acceptance does not confirm receipt of payment or approval of artwork. Printing begins once payment and print-ready artwork have both been confirmed. If clarification is needed, we contact you before production. Changes to the agreed specification or price require your agreement. Accepted orders cannot be changed or cancelled at our unrestricted discretion. Your statutory rights remain unaffected.
5. Artwork and library prints
For every order using your own artwork, including a repeat order, submit the file again. You must have the rights needed to commission the print. Rights in your artwork remain with its owner. You permit Niaash and the service providers involved in fulfilling the order to use it only as needed to assess and produce your order. Public marketing use requires separate permission.
You may make and sell finished products, including clothing and home accessories, using fabric printed with Niaash library designs. Purchasing printed fabric does not transfer ownership of the design or grant permission to reproduce or distribute its digital artwork. We do not provide a customer artwork library for repeat orders. Requiring a new file for each order does not mean that previously uploaded files are automatically deleted.
6. Production and delivery
Standard production takes 3 working days for polyester and 3 to 5 working days for natural fabrics, starting once payment and print-ready artwork have both been confirmed. Courier transit is additional. Any different schedule is agreed with you. The delivery options, supported destination and final delivery charge are shown at checkout. Rolled fabric, oversized shipments or shipments above 31.5 kg require an agreed quotation before ordering. Collection from our Rzgów address is available by prior arrangement. See the shipping policy for the current delivery table.
For consumer deliveries using a carrier offered by us, the risk of loss or damage does not transfer merely when we hand the parcel to the carrier. Please tell us promptly about a delivery problem. Photographs can help, but a courier damage report or a report within 48 hours is not a condition of your statutory rights.
7. Changes and withdrawal
Contact us promptly if you need to change an order. The options depend on the stage of production and your statutory rights. The statutory right to withdraw without giving a reason does not apply to eligible non-prefabricated goods made to your specifications or clearly personalised. A product being described as made to order does not by itself remove that right. Where no legal exception applies, eligible consumers have 14 days to notify us of withdrawal, normally counted from receipt of the goods. The returns and complaints policy sets out the procedure, return costs and model notice. The custom-goods exception does not remove rights concerning goods that do not conform to the contract.
8. Complaints
Send a complaint to our email or postal address with a description of the problem and your requested remedy. An order reference and photographs are helpful when available. Consumer rights concerning non-conforming goods include repair or replacement and, where the legal conditions are met, a price reduction or termination of the contract. These rights are not limited to transport damage. We respond to consumer complaints within 14 calendar days. The statutory liability period is generally two years from delivery. We bear the costs of remedies required by law.
9. Consumer protection and disputes
Mandatory consumer rights, including rights extended by law to eligible sole traders, remain unaffected. Polish law applies without depriving consumers of mandatory protection in their country of habitual residence. Contact us first to seek a resolution. Consumers may also seek assistance from a consumer ombudsman or the competent Trade Inspection authority. Where a complaint remains unresolved, we provide the legally required information about alternative dispute resolution. These terms do not impose an exclusive court on consumers or exclude liability that cannot lawfully be excluded.
10. Language and changes
The English and Polish versions are intended to have the same meaning. Neither version is intended to reduce mandatory rights granted under the other. The terms applicable when your order is accepted govern that order. Later changes do not retrospectively alter accepted orders. Information about personal data is provided separately in the privacy policy.
